U.S. Patent Office Rejects Patent in Litigation Against Jivan

(April 08, 2009) – Jivan Biologics Inc. announced today that the U.S. Patent and Trademark Office issued an Office Action in Ex Parte Reexamination on April 3 rejecting all claims of Patent No. 6,881,571. The serial number for the reexamination is 90/009,017. This patent is the sole subject of the suit ExonHit SA and ExonHit Therapeutics, Inc. filed against Jivan Biologics Inc. in the U.S. District Court, Northern District of California on March 12, 2007. This non-final office action rejects all claims on the basis of anticipation and obviousness in light of multiple references in the prior art.
